Staying in school when housing is unstable

A federal law gives students experiencing homelessness the right to stay enrolled, enroll without the usual documents, and get transportation. Most students it covers have never heard of it.

Housing instability disrupts school in mechanical ways: a family moves and the new district asks for a lease and proof of residence nobody has; a student is staying with an aunt and is told they have to re-enroll; transport to the old school stops. The McKinney-Vento Homeless Assistance Act exists specifically to interrupt that chain, and it applies far more broadly than the word "homeless" suggests to most people.

Who the law actually covers

McKinney-Vento defines homelessness for school purposes as lacking a fixed, regular, and adequate nighttime residence. In practice that includes staying with another family because of loss of housing or economic hardship — often called doubled-up — as well as motels, shelters, cars, campgrounds, and similar situations.

Doubled-up is the important one, because it is the most common and the least recognized. A student sleeping on a relative's couch after an eviction is generally covered, and many families in that position never learn that.

The three rights that matter most

First, the right to stay at the school of origin for the duration of homelessness, even after moving out of the attendance area, when it is in the student's best interest. Second, the right to enroll immediately without the documents normally required — proof of residency, immunization records, previous school records — while the school works on obtaining them. Third, the right to transportation to and from the school of origin.

Every school district is required to have a local homeless education liaison whose job includes identifying eligible students and making these rights work. Asking for the McKinney-Vento liaison by name is the fastest route through this, and a student can ask directly.

Unaccompanied youth are covered too

A young person who is not in the physical custody of a parent or guardian — the law calls this an unaccompanied homeless youth — is covered in their own right. That means they can generally enroll themselves, without a parent signature, and the liaison is required to help.

This matters for students who have left home, been asked to leave, or are staying with friends. The relevant person to find is the same: the district's liaison. The National Center for Homeless Education maintains a directory of state coordinators who can identify the right local contact.

What to do if the school says no

If a district refuses enrollment or the school of origin, McKinney-Vento requires it to provide a written explanation and information about how to appeal, and the student must be enrolled in the requested school in the meantime while the dispute is resolved.

That last part is the one to remember. The default during a disagreement is enrollment, not exclusion. Ask for the refusal in writing, contact the state coordinator, and get a legal aid organization involved if it does not move.
