Making a family preparedness plan: the documents and decisions to sort out early

A preparedness plan is ordinary contingency planning, useful for any family and any emergency, and much easier to make before it is needed.

Our lesson on immigration family preparedness introduces this. This article is the practical checklist, and it is worth saying at the outset that nothing here is specific to immigration status: the same plan serves a family facing a medical emergency, a hospitalization, a car accident, or a natural disaster. Every family benefits from having answered these questions once, calmly, in advance.

Who collects the children, and who the school will release them to

The single most consequential item is the school's emergency contact list. A school will generally release a child only to someone named on it, so a plan that identifies a trusted adult who is not on that list will fail at the moment it is needed. Name more than one person, include people who live nearby, and update it when circumstances change.

Second: make sure the children themselves know the plan in age-appropriate terms — who is coming, where they will go, and that the arrangement is planned rather than a sign something has gone wrong. A young person who knows there is a plan copes very differently from one improvising.

Documents, and where they live

Gather copies — not originals — of: birth certificates, passports, any immigration documents, Social Security cards, medical records and insurance information, a list of prescriptions and allergies, school enrolment information, and important phone numbers including any attorney. Keep them somewhere a trusted adult can reach without you, and consider a secure digital copy as well.

Write down the phone numbers on paper. A locked phone is a real obstacle in an emergency, and children who have never memorized a number are common. A small card in a school bag with two adult phone numbers is a low-tech measure that keeps working when nothing else does.

The legal instruments worth asking about

Several tools let a trusted adult act for a child without a full guardianship proceeding, and the right one depends on the state: a caregiver authorization affidavit, a power of attorney for the care of a minor, or a standby guardianship designation that only takes effect on a specified event. The names, requirements, and what each actually permits differ substantially between states.

This is the part to ask a legal aid organization or an attorney about rather than to assemble from a template found online, because a document that does not meet a state's requirements may do nothing at the moment it is relied on. Many legal aid organizations and immigrant-rights groups run free preparedness clinics that produce these documents properly, and asking whether one is scheduled locally is a reasonable first call.
