Filing a workplace complaint: which agency handles what

Unpaid wages, unsafe conditions, and illegal child labor go to different government agencies. Knowing which one saves real time.

When that doesn't work, or the problem is serious enough to go past the workplace itself, the next step is a formal complaint — and unpaid wages, unsafe conditions, and illegal child labor are handled by different agencies, not one single office.

Unpaid wages and child labor violations: the Wage and Hour Division

The U.S. Department of Labor's Wage and Hour Division (WHD) enforces the federal Fair Labor Standards Act, which covers unpaid minimum wage or overtime, illegal deductions from pay, and violations of the federal child-labor rules — like a minor working more hours than allowed, working during prohibited hours, or being assigned to a job classified as hazardous for their age. A complaint to WHD can be filed by the worker or by someone on their behalf, and WHD can investigate without necessarily revealing who filed the complaint.

Many states also have their own labor agency that enforces state wage and child-labor laws, which sometimes go further than federal law. Filing with your state agency in addition to WHD is often worthwhile, since state law may cover something federal law doesn't reach.

Unsafe conditions: OSHA

The Occupational Safety and Health Administration (OSHA) handles workplace safety and health complaints — a known hazard that hasn't been fixed, missing required safety equipment, lack of training on dangerous equipment, or a specific incident that caused or nearly caused injury. A complaint can be filed online, by phone, or in writing, and can request that OSHA keep your identity confidential from your employer.

Workers have a specific, named right to report a hazard and to raise safety concerns without retaliation like being fired, demoted, or otherwise punished for speaking up — that protection exists precisely because employees are often the first and only people who notice a hazard before it causes harm.

Discrimination and harassment go to a different agency entirely

A wage problem and a safety problem are different from a discrimination or harassment problem, which is generally handled by the Equal Employment Opportunity Commission (EEOC) at the federal level, or a state equivalent — not WHD or OSHA. Filing in the wrong place doesn't destroy your claim, but it does cost time, so matching the complaint to the right agency from the start is worth the extra ten minutes of checking.

Before you file: what to have ready

Whichever agency applies, a complaint goes further with specifics: dates and hours worked, pay stubs or your own notes if the employer didn't provide clear ones, the name and title of anyone involved, and a plain description of what happened and when. You generally do not need a lawyer to file a complaint with WHD, OSHA, or the EEOC — these agencies are built to take complaints directly from workers, including minors.

Retaliation for filing any of these complaints — being fired, cut in hours, or otherwise punished for it — is itself something these same agencies can investigate, so being let go shortly after filing is not the end of the process.
